1. ACCEPTANCE OF TERMS
Welcome to 42-Online! 42-Online provides its service to you, subject to the following Terms of
Service (TOS), which may be updated by us from time to time without notice to you. You can review
the most current version of the TOS at any time at:
http://www.42-online.net/tos.php. In addition,
when using 42-Online, you shall be subject to any posted guidelines or rules which may be posted
from time to time. All such guidelines or rules are hereby incorporated by reference into the Terms
Of Service.
2. DESCRIPTION OF SERVICE
42-Online is a privately owned game site. Access to 42-Online Member areas, both the game tables
and the website, is considered a privilege and not a right, and will only be extended to persons
who agree to the terms of this service and abide by the site code of conduct. 42-Online currently
provides users with access to the 42-Online games tables and a members area of the 42-Online website
(available September, 2004). You also understand and agree that 42-Online may include advertisements
in order to fund the site. You also understand and agree that 42-Online may include certain communications
from 42-Online, such as service announcements, administrative messages and the 42-Online Newsletter, and
that these communications are considered part of 42-Online membership and you will not be able to opt out
of receiving them. Unless explicitly stated otherwise, any new features that augment or enhance the
current 42-Online service shall be subject to the TOS. You understand and agree that the Service is
provided "AS-IS" and that 42-Online assumes no responsibility for the problems with site stability, or
general operational issues. You are responsible for obtaining access to the Service and that access may
involve third party fees (such as Internet service provider or airtime charges). You are responsible for
those fees. In addition, you must provide and are responsible for all equipment necessary to access
the Service. Please note that there is no fee charged for using 42-Online itself.
3. YOUR REGISTRATION OBLIGATIONS
In consideration of your use of the 42-Online service, you represent that you are of legal age to form a
binding contract and are not a person barred from receiving services under the laws of the United States
or other applicable jurisdictions. Persons under the legal age may be added with the consent of a parent,
with the parent being in agreement with the following. You also agree to: (a) provide true, accurate,
current and complete information about yourself as prompted by the Service's registration form (such
information being the "Registration Data") and (b) maintain and promptly update the Registration Data
to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate,
not current or incomplete, or 42-Online has reasonable grounds to suspect that such information is untrue,
inaccurate, not current or incomplete, 42-Online has the right to suspend or terminate your account and
refuse any and all current or future use of the 42-Online (or any portion thereof). 42-Online reserves the
right to monitor the location from which you access 42-Online and to block access from any jurisdiction in
which participation is illegal or restricted. 42-Online is concerned
about the safety and privacy of all its users, particularly children. For this reason, parents of children
under the age of 18 who wish to allow their children access to 42-Online will be contacted by a member of the
42-Online staff for approval before the account is created. Please supply contact information on the
registration form. Children's participation is encouraged, but with parental approval. By
registering your child to 42-Online, you also give your child permission to access all of 42-Online
including lobby and table chats and instant messages (among others). Please remember that 42-Online is
designed to appeal to a broad audience. Accordingly, as the legal guardian, it is your responsibility
to determine whether any of the Services and/or Content is appropriate for your child. While 42-Online
strives to keep a friendly family atmosphere, it cannot guarantee it.
4. 42-Online PRIVACY POLICY
Registration Data and certain other information about you are subject to our Privacy Policy. For more

5. MEMBER ACCOUNT, PASSWORD AND SECURITY
You will receive a password and account username upon completing the 42-Online registration process. You
are responsible for maintaining the confidentiality of the password and account, and are fully responsible
for all activities that occur under your password or account. You are the only one authorized to use your
username and password at any time. No other person is to use your username and password at any time for
any reason. You agree to (a) immediately notify 42-Online of any unauthorized use of your password or
account or any other breach of security, and (b) ensure that you exit from your account at the end of each
session. 42-Online cannot and will not be liable for any loss or damage arising from your failure to
comply with this Section 5. Access to your account by persons other than the authorized user of the
account will subject this account to closure and prohibit the authorized user from opening a future account.
6. TERMINATION OF ACCOUNT AND LIABILITY ISSUES
You agree that 42-Online may, under certain circumstances and without prior notice, immediately terminate
your 42-Online account, and access to the Service. Cause for such termination shall include, but not be
limited to, (a) breaches or violations of the TOS, the Conduct policy, or other agreements or guidelines
set forth by 42-Online, (b) requests by law enforcement or other government agencies, (c) a request by
you (self-initiated account deletions), (d) any other reason where 42-Online deems it appropriate for
the continued good of the site.
You agree to indemnify and hold 42-Online, its agents and owner(s), and any other player onsite harmless from any claim or demand,
including reasonable attorneys' fees, made by any third party due to or arising out of your use of the
Service, your connection to the Service or your violation of either the terms of Service or Conduct.
Further, you agree that all terminations shall be made at 42-Online's sole discretion and that 42-Online
shall not be liable to you or any third party for any termination of your account or access to the Service.
42-Online reserves the right at any time and from time to time to modify or discontinue, temporarily or
permanently, the Service (or any part thereof) with or without notice. You agree that 42-Online shall not
be liable to you or to any third party for any modification, suspension or discontinuance of the Service.
42-Online reserves the right to amend or modify these terms or impose new terms at any time without any
notice to you. If you do not want to be bound by an amendment, you will need to terminate your registration,
if any, and refrain from using the Site or using or ordering Applications after that date.
